Terms and Conditions
This is an English translation for convenience. The legally binding version is the German original.
1. Scope & Provider
These Terms and Conditions apply to all contracts for the purchase of digital goods (eBooks and comparable digital content) via this website. The provider is David Vaupel, named in the imprint (brand „M.d.Ä.“).
2. Subject Matter of the Contract
The goods sold are digital content provided as a download in the formats EPUB and PDF. No physical data carrier is delivered.
3. Conclusion of Contract
Upon completion of the payment process (Stripe or PayPal), a purchase contract for the selected digital good is concluded. Receipt is confirmed by email.
4. Prices & Payment
All prices are final prices and include statutory value added tax. Payment is made via the payment methods offered during the ordering process.
5. Provision
After successful receipt of payment, the files (EPUB and PDF) are sent by email. In addition, a personal download link is provided, which is valid for 30 days.
6. Rights of Use
With the purchase, a simple, non-transferable right of personal use is granted. Passing on, reproduction for distribution, or resale is not permitted. Each copy is marked with a personal identifier for traceability.
In the case of a gift purchase, the buyer is the contractual partner (payment and declaration of withdrawal); the gifted person is the beneficiary and receives the files. The personal identifier is then issued to the recipient's address. An optionally booked dedication is included in both formats.
7. Right of Withdrawal
The withdrawal policy applies. For digital content, the right of withdrawal expires once execution (download) has begun after express consent (§ 356 para. 5 BGB).
8. Liability
Liability is governed by the statutory provisions. For slight negligence, liability arises only in the event of a breach of essential contractual obligations and is limited to the damage typical for the contract.
9. Final Provisions
The law of the Federal Republic of Germany applies. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
